Terms & Conditions

1 General
The following General Terms and Conditions of Business shall be valid for the entire business relationship between viction:workshop ltd. (“Shop”) and the purchasing person (“Orderer”) regarding the online shop under the domain of www.victionary.com (“the Site”).

Changes to the Shop’s Terms and Conditions are made from time to time, and the Orderer’s continued use of our website following any change shall be deemed as the Orderer’s acceptance of such change. It is the Orderer’s responsibility to read the Terms and Conditions carefully before accepting them and regularly check the Terms and Conditions for changes.

2 Delivery and Consignment
The product(s) will be delivered from the Shop to the address which the Orderer provided in his/her/their order if not agreed otherwise. Any information in connection with the period required for delivery is without guarantee unless the Shop has expressly assured a certain date of delivery to the Orderer.

This limitation of liability shall apply also for our employees, representatives and any person employed by the Shop in the performance of its obligations, excluding circumstances where such loss or damage is not a reasonably foreseeable result of any breach of duty of care; any increase in loss or damage resulting from a breach by the Orderer to any of these Terms and Conditions; or such loss or damage relates to any business or non-consumer loss or damage including but not limited to, lost data, lost profits and business interruptions.

If an error is discovered in the price of the product(s) the Orderer has ordered, the Shop will inform the Orderer and issue a full refund as soon as possible. The Shop shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. If the product(s) has been charged and not despatched, the Shop will cancel and refund respective orders.

Although the Shop aims to keep all details, descriptions and prices of products appearing on the Site as up-to-date as possible, the Shop does not guarantee that the information (including product descriptions) always reflect its exact position at the point of order. The Shop also reserves the right to alter prices to take into account forces beyond the Shop’s control (e.g. currency fluctuations) without prior notice.

The Shop reserves the right to withdraw any product(s) from the Site at any given time and/or remove or edit any materials or content on the Site. Note that availability, conditions, dates and prices may change from time to time without prior notice. The Orderer should check those prior to making a purchase.

3 Payment
Payment transactions can be made in US Dollars ($/USD), Pound Sterling (£/GBP), Euro (€/EUR) and Hong Kong Dollars ($/HKD). The Orderer may choose a currency from the navigation menu to change the price displayed.

All offers on the Site are not binding and are without commitment. In each case, a valid contract shall only result and become effective by the Shop’s written confirmation of the order through e-mail, by mail or at the latest, when the Shop performs the order. With regard to an ordered product which is not set out in the confirmation order, no sales contract shall be deemed to have been closed with regard to. The amount(s) payable mentioned in such a confirmation notice is/are due with the receipt of said confirmation.

Payment can only be made through the Orderer’s Paypal account or credit card, and an invoice purchase is not possible. All purchases made on the Site are final and non-refundable.

If the Orderer defaults on the payment of an order, the Shop is entitled to withhold further orders and will not be in default of delivery in such an event. It is not necessary that the Shop expressly announces/exercises its said right to so withhold orders.

4 Packaging and Shipment
The Shop will package the product(s) according to custom and usage.

The Shop is entitled to choose the route and means of transport if not otherwise expressly agreed with the Orderer. As a rule, international shipments will be done by FedEx, and local shipments by S.F. Express.

Postage will be charged for each purchase on top of the nominal or discounted unit price(s). Postage differs by destination. Additional postage might be charged for orders from new locations not recognised in the online system at the time of the order. The Shop will take all reasonable care to ensure that goods and/or products are delivered in their original conditions but is not liable for any damages of the goods and/or products caused once it leaves the Shop’s warehouse and/or during the course of delivery made by the courier.

5 Reservation of Title
The product(s) delivered remains the property/reserved product(s) of the Shop until full payment of all (including future) claims resulting from the Shop's contractual relationship with the Orderer is received. These claims include conditional claims as well as claims which have been included by the Shop in a current account. The extended reservation of title is hereby granted to the Shop so that any and all claims resulting from a resale are transferred to the Shop in the amount required to cover its own claim(s).

In the event that the Orderer should be in default of payment, it is obliged, upon the Shop’s and/or its affiliates' demands, to allow the Shop to repossess the reserved product(s) still in the Orderer’s possession, to provide the Shop with a detailed list of the said product(s), to isolate the applicable product(s) and to return/transfer the same to the Shop.

6 Liability for Defaults
The product(s) will be delivered with the characteristics and quality that are customary for the manufacturer at the time of delivery, if this is reasonable for the Orderer in consideration of the Shop’s interests.

Certain qualities shall only be deemed to be assured if the Shop and the Orderer agrees to the same in writing.
 The Shop is not liable if any delivered product(s) infringes on foreign copyrights or other foreign industrial property rights of third parties.

The Orderer is obliged to check the delivered product(s) after receipt to verify if the same is free from faults. The Orderer is obliged to notify the Shop in writing within 7 (seven) working days after receipt if the product(s) is apparently faulty. This written notice must contain the exact description of the default and the order number. Proof that the notification was sent in due time shall be deemed as the date of the postmark or any other provable date specification.

In case a purchased item is faulty, the Orderer shall be entitled to ask for a supplementary/complementary performance. Diminution shall be excluded. Any further claims of the Orderer shall be excluded if not otherwise mentioned.
